Will Gays Ever Be Able To Get Married In California?

Get used to seeing more pictures like this, because the fight isn’t over just yet. Same-sex couples in California will not be granted the opportunity to secure marriage licenses tomorrow. A federal appeals court has placed a hold on same-sex weddings, while it considers the constitutionality of Proposition 8.

Oral arguments will begin on the week of December 6th, which means we probably won’t hear a decision until early 2011. Although we’re trying to avoid getting bummed out about this, it’s starting to feel like this will never come to an end! On a brighter note? At least same-sex couples in Mexico City can now adopt children…

From what I’ve been reading this is actually a good thing, it allows the fed circuit court to expedite the case as quickly as possible and get a decision which will most likely be appealed and then off to the supreme court. Even the lawyers for the two couples who filed suit agreed this was what they wanted to see.

  2. Schwarzenegger & Brown the actual defendants in the case, refuse to defend Prop 8. Who are these Protect Marriage nuts?? I hope the 9th tosses their appeal out the courthouse window.

  4. The most unfortunate thing to come out of this Prop 8 fiasco, besides the fact that gays can’t marry, are those stupid No H8 pictures.

    For serious people. Stop taking these pictures. They make you look stupid. The pictures are stupid. The overexposed, too white, the I’m-trying-to-look-sexy-with-a-duct-taped-mouth look…ugh.

    The first few were effective. Now they’re just annoying.

  5. I can’t wait until this to be shot down so we can start reporting on all the marriages that inevitably will fail. Exciting times!

  6. This isn’t merely about marriage. It’s about equality. Honestly, the message above echoes a common sentiment that makes me hate my species.

    Marriage, whether you like it or not, is a Federal Institution. It is embodied in over 1000 Federal laws and statutes, not the least of which is the Fair Faith and Credit Act.

    By denouncing marriage equality what you are -really- saying is “gays have interpersonal relationships that are inferior to those of heterosexuals and therefore they can be denied their Constutional rights to equal access on this basis.”

    The Constitution does not guarantee equal rights for everyone. This is what due process is all about. There are circumstances in which rights may be withdrawn or withheld. If the courts find that gay relationships are inferior on some basis (eg. a compelling state’s interest), then we will have had due process and discrimination will be codified into American law.

    The conservative groups are defending their faith-based traditional views of marriage, but as citizens of America, that is not what this is really all about. It’s really about equality, fairness, and equal protections.

  7. DivorceAdvocate: I agree. Guys can’t stay together for the most part. Even tho I am for monogomy, it seems that most guys can’t handle it, by the posts on here lately.

  8. I bet the divorce lawyers are rubbing their greedy hands together in glee…just waiting for this to pass. Be sure to send your kids to law school…they are going to have work for the rest of their lives.
