Propositon 8 Supreme Court Hearing Live Feed

Today is the day when the Supreme Court of California will decide the fate of Proposition 8 as well as the 18,000 marriages that took place prior to the passage of the ban. The oral arguments will begin at 12 pm ET and you can watch them live right here!

The court room will be packed with various groups representing different arguments. The main players to watch for:

Jerry Brown: The Attorney General of California, originally supported upholding Prop.8, but had a change of heart and is now arguing for its repeal.

Ken Starr: Arguing for upholding the ban, famous intruder of other's personal lives (See the Lewinsky Scandal).

The three main questions that will likely be answered today:

  • Does Prop. 8 constitute an amendment to the Constitution of California? If so, the ban as it is would not stand because proper procedures were not followed.
  • Is "Separation of Powers" violated by Prop. 8? "Prop. 8 foes also argue that the measure violates the constitutional
    separation of powers by preventing the judiciary from protecting a
    minority group."
  • 18,000 marriages already occured, what happens to those if Prop. 8 stands?

UPDATE: The hearing is over and it doesn't look good. Those on the side of overturning Prop. 8 made weak arguments, and came off as unprepared. I'm fairly confident the court will uphold Prop. 8, but the already existing marriages' legality is still up in the air and will likely come to a close vote. It looks like our own ballot initiative in 2010 will be the way to go.

  1. Jerry Brown is kicking ass, but it’s not lookin great. I suspect they’ll keep the 18000 marriages, but also uphold Prop. 8 but i’m still hopefull
